Terms of Service

This Terms of Service Agreement (“Agreement”) is a legal agreement between you (“User”, “You”) and Rahul Chowdhury (“we”, “us”, or “our”) governing your use of the Foreweek application (the “App”).

By downloading, installing, or using Foreweek, you agree to be bound by this Agreement.

If you do not agree, do not use the App.

1. App Overview

Foreweek is a weekly planner for your goals.

The App provides tools for:

• Planning goals for the week ahead and marking their priority
• Keeping unscheduled goals in an inbox until you’re ready to plan them
• Looking back at the goals you planned and completed in past weeks
• Syncing your plans across your devices through your own iCloud account

Foreweek does not require you to create an account with us.

2. Purchase

Foreweek is sold as a one-time purchase on the Apple App Store.

• The price is shown on the App Store before you buy and is charged by Apple
• Payments are processed entirely by Apple, and we never receive or store your payment details
• There is no subscription and no recurring charge for the App
• Your purchase includes the App as it is offered on the App Store, along with the updates we choose to release for it

We may change the App’s price at any time. Price changes do not affect purchases already made.

3. Licence to Use the App

Subject to compliance with this Agreement, we grant you a:

• Personal
• Non-exclusive
• Non-transferable
• Revocable

Licence to use Foreweek for your own, non-commercial purposes, on Apple devices that you own or control and as permitted by the App Store’s Usage Rules.

The App is licensed, not sold.

4. Your Data and iCloud

Your goals, inbox, plans, and history are stored on your device.

When you’re signed in to iCloud on your device, they are also synced automatically through the private iCloud database of your Apple Account, which is operated by Apple.

By using Foreweek, you acknowledge and agree that:

• We do not operate servers that store your goals or plans, and we cannot access, view, recover, or restore them
• Syncing depends on Apple’s iCloud service, your iCloud settings, your available iCloud storage, and internet connectivity
• Your use of iCloud is governed by Apple’s own terms and privacy policy
• You are responsible for keeping backups of any information you want to preserve
• Deleting a goal or other data in the App may also delete it from your other devices that sync with the same Apple Account
• Deleting the App does not delete your data from iCloud (see Section 11)

5. Analytics and Usage Data

We collect limited usage and diagnostic data to improve the App, using PostHog as our analytics provider. This data is stored in the European Union.

This includes:

• App usage events
• Crash and error reports
• Device and operating system information
• Approximate location, derived from your IP address
• A pseudonymous identifier created when you install the App

Analytics data never includes the contents of your goals, inbox, or anything else you write in the App.

If you choose to share diagnostics with app developers in your device settings, Apple may also provide us with crash reports and diagnostic data under Apple’s own terms.

6. Restrictions

You may not, and agree not to:

• Resell, rent, sublicense, or commercially exploit the App
• Reverse-engineer, decompile, or modify the App, except where applicable law expressly permits it
• Attempt to bypass the App’s purchase or licence checks
• Interfere with the App or the services it relies on
• Use the App in violation of any applicable law

7. Ownership

All rights, title, and interest in Foreweek, including software, design, branding, and intellectual property, remain the exclusive property of Rahul Chowdhury.

This Agreement does not transfer ownership rights to you.

Your goals and plans belong to you. We claim no ownership of, or licence to, the content you create in the App.

The fonts and open-source libraries listed under Acknowledgements in the App remain the property of their respective owners and are used under their own licences.

8. Third-Party Services

Foreweek relies on third-party services and providers, including but not limited to:

• Apple (App Store distribution, payments, and iCloud sync)
• PostHog (product analytics and crash reporting)

We are not responsible for the availability, security, or practices of third-party services.

Your use of those services may also be subject to their respective terms and privacy policies.

9. Modifications and Updates

We may:

• Update or improve the App
• Add or remove features
• Stop supporting older versions of iOS or older devices

Updates are delivered through the App Store and may occur without prior notice.

We are not obligated to maintain any specific feature indefinitely, or to continue releasing updates for the App.

10. Refunds

Because the App is purchased through the App Store, refunds are handled by Apple under Apple’s refund policies. We are unable to issue refunds directly.

You can request a refund from Apple at reportaproblem.apple.com.

Nothing in these Terms limits any non-waivable consumer rights granted under applicable law.

11. Termination

This Agreement remains in effect until terminated.

You may terminate it at any time by deleting the App from all of your devices.

Your licence ends automatically if you violate these Terms. On termination, you must stop using the App and delete it from your devices.

Data synced through iCloud may remain in your Apple Account after you delete the App, until you delete it from your iCloud storage settings.

12. Warranty Disclaimer

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Uninterrupted or error-free operation
• Continuous availability of syncing

We do not guarantee that the App will always work as expected, be free from defects, or sync your data without delays or interruptions.

The App may experience sync delays, sync conflicts, or data loss due to technical issues, updates, iCloud outages, device problems, or other third-party providers.

We are not responsible for losses or damages resulting from such interruptions or failures.

13. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability shall not exceed the amount you paid for the App
• We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, missed goals or deadlines, lost profits, or business interruption

You acknowledge that Foreweek is a planning tool, and that you remain responsible for your own tasks, commitments, and deadlines.

14. Indemnification

You agree to indemnify and hold us harmless from claims, liabilities, damages, or expenses arising from:

• Your use of the App
• Violation of these Terms
• Violation of applicable law
• Violation of any third-party rights

15. App Store Terms

Because you get Foreweek from the Apple App Store, you also acknowledge and agree that:

• This Agreement is between you and us only, not with Apple, and we, not Apple, are solely responsible for the App and its content
• Apple has no obligation to provide any maintenance or support for the App
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to meet any legal or regulatory requirement, and consumer protection claims
• Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party claim that the App or your use of it infringes that third party’s intellectual property rights
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties
• Apple and its subsidiaries are third-party beneficiaries of this Agreement, and Apple has the right to enforce it against you

Where this Agreement and Apple’s Licensed Application End User License Agreement conflict, this Agreement applies to the extent permitted by the App Store’s rules.

16. Governing Law

This Agreement is governed by the laws of India, excluding conflict of law rules.

Any disputes shall be resolved exclusively in courts located in India.

17. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the date at the bottom of this page. For significant changes, we will also let you know in the App’s release notes or on our website.

The latest version will always be available on our website. Continued use of Foreweek after changes become effective constitutes acceptance of the updated Terms.
